Erie Mortgage Recording Tax Needs the Dwelling Split

Erie County mortgage recordings use page fees plus mortgage tax rules that change by dwelling type.

Erie County mortgage recording is a math check, more than a signature check. Recording a mortgage includes a $45 cover-page charge plus $5 per written side of a page. New York State mortgage tax is due at recording. Erie also lists mortgage tax at 1 percent of the total mortgage amount.

Some one- or two-family dwelling filings can reduce the amount by $25 when the required dwelling statement appears. The fee schedule also breaks out who pays portions of the tax by property type.

Keep the mortgage amount, property type, dwelling statement, page count, fee calculation, and Clerk confirmation with the closing figures. Recalculate if the document length or property classification changes.
